DUI and Drugs Charges

You may be charged for DUI Drugs if your ability to drive is impaired.  If a police officer believes you are impaired due to drugs, the officer will take you to the station to be evaluated by a Drug Recognition Evaluator (DRE).  The DRE follows a 12 step procedure.  This includes agility tests, inspection for injection marks, examination of your nose, a blood test or urine test and inquiries about what drugs you have been taking.   At the conclusion, the DRE makes an evaluation on whether to charge you for DUI Drugs.  At the trial, this same DRE will appear as a witness against you using the evaluation to secure your conviction.

DUI and Drugs Lawyer in Oxnard Defends against DUI Drugs Charges

Our Criminal Defense Department at the firm is skilled at countering DRE conclusions.  Here are some of the points we may raise:

  • Illegal Stop: If the police officer did not have probable cause to stop the client, we move to exclude all the evidence.
  • Failure to Read Rights:  If the DRE failed to notify the client of the right to remain silent, we move to exclude the client's admissions in the interview with the DRE.
  • Challenge of Drug Tests:  A blood test or urine test only shows the presence of drugs, not the amount of drugs.  Our client may well have a tolerance of the drugs from past use and so a little bit would have no effect on the client's ability to drive.  We also can present expert testimony that drugs can remain in the system for weeks, long after they have any effect on the client.
  • Innocent Explanations:  Fatigue, allergies and nervousness may explain any impairment the evaluator observes.
