Multiple DUI Penalties

The state counts back 10 years in determining how many DUI's you have.

• Second DUI:  This is a misdemeanor.  Your mandatory jail time is 96 hours.  Fines, fees and costs can range from $1,800 to $2,800.   You are likely to have your license suspended for two years but can apply for a restricted license after one year.  You will then need to install an ignition interlock device.  This is a breath test device the size of a cell phone installed on your dashboard.  You have to blow into it to start your car.  If you flunk, the car will not start.
• Third DUI: Still a misdemeanor.  The mandatory jail time is up to 120 days.  Your license suspension is 3 years and the DMV may or may not let you have a restricted license.
• Fourth DUI: This is a felony.  You may be sentenced to the state penitentiary for up to three years.  Your driver's license may be revoked indefinitely.
